Competency/Learning Objective - Legal knowledge and skills
This course considers recent developments and the latest cases in relation to professional liability in both contract and tort, including a discussion of topics such as the scope of a professional’s duty, recoverability of damages and causation. Links to relevant source materials are provided.
By the end of the course you should be able to advise authoritatively on topics such as:
the extent of a solicitor’s duty to the other party to a transaction
determining the proper scope of a professional’s retainer
the correct approach to the assessment of damages
whether the extended limitation period under Limitation Act 1980, s 14A can be excluded
